Jaipur consumer commission orders repair or replacement of defective car; Compensation for trouble caused

JAIPUR: Jaipur District Consumer Commission has ruled that failure to provide service to a consumer after purchasing a vehicle or item is a serious defect.

In the case of AMP Motors Limited, the company has been instructed to repair or replace the faulty Jaguar car of the complainant, Rajesh Lodha, and pay compensation for the trouble caused.

According to Lodha, he purchased the Jaguar XE diesel car on April 29, 2017 for Rs 69.70 lakh and took delivery on May 11, 2017.

However, problems began surfacing two-three months later, and after keeping his car at the opposition’s service center in Sitapura for 49 days, it was returned without rectifying the deficiencies mentioned by him. The complainant had to hire a taxi for his business work due to lack of use of his car.

The Commission Chairman Devendra Mohan Mathur and Member Seema Sharma ruled in favor of Lodha and imposed a compensation of Rs 5.50 lakh on AMP Motors Limited for not rectifying the deficiencies in the car despite being informed about them several times.

The company has also been ordered to pay interest at 9 percent per annum on Rs 69.70 lakh for a period of one year starting from June 15, 2018.

If AMP Motors Limited fails to repair or replace the faulty car within one month from today’s date, they will have to pay Rs 69.70 lakh along with interest at an annual rate of nine percent from June last year till payment is made in full (including principal amount).
