Pankaj Choudhary moved the state high court<\/a> on Friday after his nomination paper from Barmer-Jaisalmer seat for upcoming elections was rejected by Election Commission.<\/p>\n\n\n\nHe requested direction to the election commission from court\nto issue him the certificate.<\/p>\n\n\n\n
Lok Sabha 2019 polls on Barmer seat are scheduled for April\n29 and the nomination process has already been over for it. Choudhary now wants\nto contest elections from Bikaner seat for which he demanded the certificate\nfrom election commission at earliest that will enable him to contest the\nelections.<\/p>\n\n\n\n
Bikaner constituency will go on polls on May 6. The last day\nof nomination for the seat is April 18. <\/p>\n\n\n\n
Election Commission rejected the nomination form of\nChoudhary on Wednesday on the grounds that he did not attach the letter of\ntermination from his services by government or permission certificate from EC\nwith his nomination form.<\/p>\n\n\n\n
According to the rules, no officer can contest the election\nafter being terminated by central or state government from his\/her services due\nto any reason. The officer didn\u2019t permit for the same before filing his\nnomination.<\/p>\n\n\n\n
Pankaj Choudhary\u2019s advocate Ramvatar Singh said that Pankaj\nwas terminated from IPS on the charges of the extramarital affair and not for\ncorruption or disloyalty for the state. He must get the certificate from the\nelection commission to contest the elections under Section 33 of the\nRepresentation of People Act, 1951.<\/p>\n\n\n\n
The court directed the election commission officials to\ndecide on Choudhary\u2019s application and revert by April 16 to the court.<\/p>\n","protected":false},"excerpt":{"rendered":"
