Rajasthan High Court rejects second bail pleas in cyber fraud case, cites large-scale bank transactions

Jaipur: The Rajasthan High Court has rejected second bail applications filed by two accused in a cyber fraud case after taking note of the volume of transactions reflected in their bank accounts and the number of cyber complaints registered against them.

Justice Justice Anoop Kumar Dhand passed the order while deciding S.B. Criminal Miscellaneous Second Bail Application No. 16064/2025 filed by Vivek Yadav and the connected S.B. Criminal Miscellaneous Second Bail Application No. 15712/2025 filed by Karan Yadav.

The court recorded that earlier bail applications filed by both petitioners, along with co-accused Meghraj Saini, had been rejected by order dated October 13, 2025, while granting liberty to revive the prayer for bail after completion of investigation.

During the hearing of the second bail applications, counsel for the petitioners submitted that investigation had since been completed and a charge-sheet had been filed. It was submitted that as per the charge-sheet, an amount of Rs.3,16,500 was recovered from different bank accounts of petitioner Karan Yadav in connection with seven cyber complaints, and an amount of Rs.1,92,500 was recovered from different bank accounts of petitioner Vivek Yadav in connection with nine cyber complaints.

The petitioners contended that they were innocent, that their bank accounts had been misused by a co-accused, and that they had no criminal antecedents. It was further submitted that the alleged offences were triable by a Magistrate and that the trial would take time to conclude.

Opposing the bail applications, the Public Prosecutor submitted that investigation revealed transactions amounting to approximately Rs.2,27,64,000 across different bank accounts of Vivek Yadav between February 2024 and August 2025. It was further submitted that bank accounts of Karan Yadav were found to be involved in fraudulent transactions amounting to approximately Rs.14,05,000. The prosecution opposed grant of bail in view of the amounts involved and the number of complaints.

After perusing the charge-sheet and case diary, the High Court recorded that large amounts running into lakhs of rupees were deposited in the petitioners’ bank accounts during the period 2024–2025, and that no such transactions were found prior to that period. The court noted that the exact amount deposited was disputed and would be examined by the trial court at the appropriate stage.

The court further recorded that nine cyber complaints were received against the bank accounts of Vivek Yadav and seven cyber complaints against the bank accounts of Karan Yadav. It observed that the question whether the petitioners were innocent or whether their accounts were misused could not be examined at the bail stage and would be considered during trial.

Taking into account the gravity of the matter and the transactions reflected in the bank accounts, the High Court held that no grounds were made out for grant of bail. The court found no material change in circumstances since the earlier rejection of bail.

Accordingly, both second bail applications were dismissed. The court clarified that nothing stated in the order shall be construed as an expression of opinion on the merits of the case.

Before parting with the order, the High Court made observations regarding the rise of cyber crimes and digital frauds and recorded the need for public awareness, regulatory measures, and coordination among stakeholders. The court directed that a copy of the order be sent to the concerned Ministries, the State Government, the Director General of Police, Rajasthan, and the Reserve Bank of India for necessary compliance.
