Jaipur family court enforces Rs 8.98 lakh maintenance recovery from software engineer via warrant

Jaipur: A family court in Jaipur has enforced recovery of nearly Rs 9 lakh in maintenance arrears from a software engineer after he allegedly failed to comply with an interim order directing him to pay Rs 73,000 per month to his wife and two school-going daughters.

Judge Pawan Kumar Garg had passed the interim maintenance order on 8 January 2026 in case number 362/24, filed under Section 144 of the Bharatiya Nagarik Suraksha Sanhita. The wife, who is not employed, had filed the petition in October 2024 seeking maintenance for herself and the couple’s two children, both of whom are enrolled in school.

According to DS Shekhawat, family court advocate who represented the wife, the husband works as a software engineer at a reputed private company and earns a monthly salary of Rs 2 lakh. He also owns a house in Jaipur that generates Rs 15,000 per month in rental income, bringing his total monthly earnings to Rs 2,15,000 as stated by the petitioner.

Under the interim order, the court directed the husband to pay Rs 35,000 per month to the wife, Rs 20,000 to one child, and Rs 18,000 to the other — totalling Rs 73,000 per month. The maintenance was made effective from 25 October 2024, the date the petition was originally filed. The order for the wife was to remain in effect until she acquires her own means of income, while the payments for the children were linked to specific age-related milestones.

When the husband allegedly failed to pay, the petitioners calculated arrears of Rs 9,70,984 and filed a recovery application on 29 January 2026. The court then issued a commissioner warrant against the husband. Acting on the warrant, police recovered Rs 8,98,926, which was deposited as a demand draft at the police station and subsequently transferred to the court. On 7 April 2026, the court released the entire amount to the petitioners.
