Jaipur court dismisses accident insurance claim of Rs 23.50 lakh for lacuna on part of claimant
The claimant failed to provide the correct information about the accident at the hospital.

JAIPUR: A court in Jaipur dismissed the accident insurance claim of Rs 23.50 lakh filed by a bicycle rider.
The claim was dismissed on the grounds that he didn’t provide the correct information about the accident at the hospital and there was no mention of the incident in the discharge ticket. There was also an unexplained delay of 29 days in the registration of the accident complaint.
The accident occurred on April 23, 2018. Claimant Kailash Chand Sharma stated in his claim that he was going toward Durgapura from Chenpura on his bicycle. A car hit his bike following which he was seriously injured and was rendered handicapped. He underwent treatment at a hospital.
He filed a claim of Rs 23.50 lakh against the National Insurance Company and the car driver in the Motor Accident Claim Tribunal Court – 2 of Jaipur Metro – 1.
The tribunal held that the claimant didn’t provide the correct information to doctors about how the accident occurred and there was no mention of the accident in the discharge ticket. There was a delay of 29 days in the registration of the accident complaint.
Based on these grounds the accident claim was dismissed by the court.
